Depending on your relationship with us, we may collect:
As a care provider, we necessarily process special category data — in particular information about health. We may also process information revealing other special categories where relevant to care. We only process such data where a condition under Article 9 of the UK GDPR applies — most commonly that processing is necessary for the provision of health or social care (Article 9(2)(h)), and in line with the conditions in Schedule 1 of the Data Protection Act 2018. We maintain an appropriate policy document governing this processing, as required by the Data Protection Act 2018.
We use personal data to provide and manage care, to recruit and employ staff, to meet our regulatory and legal duties, and to respond to enquiries. Our lawful bases under Article 6 of the UK GDPR include:
We share personal data only where necessary and lawful, including with: healthcare professionals and the NHS; the Care Quality Commission (CQC); local authorities and safeguarding bodies; the Home Office and UK Visas & Immigration (for sponsored workers); the Disclosure and Barring Service (DBS); our professional advisers; and trusted service providers (data processors) who act on our instructions. We do not sell your personal data. Our processors include our website hosting provider, our email/communications provider, and other trusted suppliers who process data on our behalf under written contracts that require them to protect it.
We keep personal data only for as long as necessary for the purposes described, or as required by law and regulatory guidance (for example, health and care records are subject to NHS/sector retention schedules). In general: adult social care and health records are kept for around 8 years after our care ends (or longer where law or NHS/sector retention schedules require); staff and payroll records for up to 6 years after employment ends; records of unsuccessful job applicants for up to 12 months; and general enquiries for up to 2 years. When data is no longer required, it is securely deleted or anonymised.
Under UK data protection law you have the right to: be informed; access your data; have inaccurate data corrected; have data erased in certain circumstances; restrict processing; data portability; object to processing; and rights relating to automated decision-making. We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss or misuse, and we keep these measures under review. Access to personal and care data is restricted to those who need it to carry out their role.
